My dad defended the two cousins. My only contribution in the case was to discuss the case with my dad and arrange documents for him. We also decided to congratulate the two cousins. I have seen them so many times in the court silently standing behind my dad when he was arguing the case. People in the court room would elbow each other and gossip while looking at the two cousins.
We reached the village at 8pm. The earlier crowd had disappeared. Five elders of the family were waiting outside the village to receive us. When we reached near the house of Banaras, a crowd of around 60 people was present. They started chanting slogans for my dad. He was garlanded with roses and currency notes. Two drum beaters also appeared from somewhere. I also got my share of garlands and sloganeering. I have never been through such an experience before. We were seated in the drawing room where people were coming from one door and leaving from the other meanwhile, thanking my dad and asking who is this chouta wakeel.

Incestuous gang rape: People give befitting welcome to persons involved in incest case
Around 200 people were present outside the District Jail, Jhelum. They were waiting for the release of Banaras and Najeeb. It took jail authorities an hour to complete the documentation. Then Banaras and Najeeb appeared from the small door of the jail. Amid loud sloganeering, they were taken towards the cars parked at a little distance from the jail. Local media and a large contingent of the police were also present outside the jail.
The 200-strong crowd started multiplying. When the motorcade carrying the two cousins reached their home town, the crowd had grown to around 700 people. In village Jalo Chak, women gathered on the rooftop to have a glimpse of the two cousins who remained in the jail for 19 months facing the most heinous of the crimes.

Father, uncle rape girl: What makes court believe girl is a liar?
Irum, the girl who accused her father and uncle of raping her, was doing it on behest of her mother Sakina Bibi. Sakina wanted a share in the property of her ex-husband, something which Islamic law don’t allow. Sakina in connivance with the political rivals of Banaras and Najeeb, lodged the fake FIR against the two cousins.
Irum, who claimed in the court to be a virgin, said in her evidence that she was raped two days prior to the registration of the FIR. However, her medical examination by a lady doctor suggested otherwise. Doctor Adeela Kanwal mentioned in her report that the girl was sexually active woman who kept poor personal hygiene. The doctor also said that hymen was missing and there were no recent healing signs around it which suggested that she had started her sexual life quite earlier than the date of the registration of the FIR and she had been having sex regularly.
No signs of violence were present on her neck, breasts and inner thighs. The doctor also reported that the girl had changed clothes and taken a bathe before coming for the medical examination. Law all across the world, requires rape victims to get examined without changing their clothes or taking bathe. Changing clothes and taking bathe often destroys vital evidence.
Irum also said in her evidence that she used to be raped in the house of her father. Najeeb’s house had no main gate; it comprises of two bedrooms and was shared by seven people, including the second wife of Najeeb, his blind mother and his 18-year-old daughter.
She was unable to give a valid answer as to why she did not try to get sympathies of the people living in the small house.
Irum failed to answer as why she did not run from the house which had no main gate.
She could not answer the question as why she did not raise hue and cry when the house was surrounded by other houses from all sides.
The defense counsel produced some love letters purportedly written by Irum to her boy friend Asim. The girl refused to own the letters. She was asked to write some words in the courtroom. Below is brief profiles of the people accused of committing incestuous gang rape. Irum has accused her father Najeeb and her uncle Banaras of raping her.
Daughter ‘rapist’ is poor shopkeeper
Najeeb had been running a small grocery shop in the village Nakodar, near Mangla Cantonment. He had re-married after divorcing his first wife Sakina Bibi. He fathered four children from his second wife. Najeeb’s small store was not sufficient to meet the needs of his family. His mother, who was vision impaired due to old age, also lived in the house. The old woman died after her son was arrested.
The family shared a house having two bedrooms, one storeroom, one kitchen and one toilet. The meager finances of the family never allowed them to install the main gate of the house. Being surrounded by the other houses from all the sides and being located in the middle of the village, gave the family enough sense of security to live without the main gate – otherwise a necessity for the insecure times we are living in.
Second accused in popular general councilor
The second accused of the incestuous gang rape is a general councilor. He is very popular in his area. His only daughter is married and lives in the United Kingdom. He has a very large social circle. He has contested four elections and lost only one. He defeated a rival family twice. Banaras lost the last local government elections as he was a candidate of the PML-Q which had a very poor ranking. No criminal proceedings were ever initiated against him. People of his area trusted him and happily appointed him as arbitrator to settle their disputes. Banaras remained in various cities after the FIR was lodged against him to avoid getting arrested.

Incestuous gang rape: Mother accuses father of raping daughter
Councilor Banaras was called in the local police station in the evening. Visiting the police station of his area was a routine matter for him as the police-shy people of his constituency often took him along whenever they had to deal with the police.
What awaited him in the police station later turned out to be a big shock for him. He met the ex-wife, Sakina Bibi, of his cousin Najeebur Rehman and the couple’s only daughter Iram Najeeb.
Banaras had witnessed so many family disputes between the couple during their troublesome marriage. Sakina Bibi had been lodging various complaints against her ex-husband before police and other authorities. Banaras seated himself on the table where Sakina, Irum and a police official were also sitting.
Without listening to Sakina Bibi, Banaras assured her that he would settle the new dispute whatsoever. He had heard rumours that Sakina Bibi wanted a share in the property of her ex-husband.
The first sentence Sakina Bibi uttered in the police station was, “I have been smelling foul stink (sic) from Irum. Najeeb has been raping her.”
This disclosure was too shocking for Najeeb. He yelled at her in disbelief. Then came the second attack, this time from the girl. She told the policeman that Banaras had also been raping her.
